Generative AI and Law: Copyright Challenges from Training Data to AI Outputs

Current work on the Diamond Discovery Hub (DDH) at the European Diamond Capacity Hub has revealed that journal ownership is one of the most significant hurdles for journals to comply with the 6 operational criteria that determine admission to the DDH.

The criterion specifies that journals should be “community-owned”, and community ownership is defined as “The journal title must be owned by public or not-for-profit organisations (or parts thereof) whose mission includes performing or promoting research and scholarship. These include but are not limited to research performing organisations (RPOs), research funding organisations (RFOs), organisations connected to RPOs (university libraries, university presses, faculties, and departments), research institutes, and scholarly societies. The journal should explain its ownership status on its webpage”.

In many cases, journal editors and publishers have never given thought to ownership, because they see their contributions to the journal as community service and part of their tasks as scholars. This situation has led many Diamond journals to be taken over by commercial publishers with little or no pushback. A strong and resilient Diamond OA ecosystem needs to make sure that Diamond OA journals are legally owned so that predatory take-overs can be effectively resisted.

In addition, within the Diamond OA community, questions arise as to what ownership of a journal title really means when all of its contents is CC BY. Under that view, the journal is then just the thread that binds these articles together, and there is nothing to own. However, it can be argued that every journal has a bundle of intangible assets. These assets include the journal title, its ISSN, its aims and scope, its database of authors and reviewers, its archives, its governance and organisation, editorial and publishing policies and its social capital in the journal’s community. Together, these do represent a set of identifiable resources that can be owned by a legal entity.

In this workshop, we will invite a number of specialists to discuss their perspective on the issues of determining journal ownership, focusing on three aspects:


What are the practical difficulties encountered by a DDH Trusted Source to identify journal ownership?
What are practical solutions to handle journal ownership?
What mechanisms can help balance potential tensions between editorial independence and ownership?
How can we define what assets are “owned” when “journal ownership” is discussed?

Dr. Maja Bogataj Jančič is the founder and head of the Open Data and Intellectual Property Institute, ODIPI. Maja is a copyright expert; her current work focuses on copyright and Open Science, open data, and data governance for AI. Maja is the National and Regional Coordinator for the Knowledge Rights 21 programme. In the past she has been ERA (European Research Area) Action 2 (impact of copyright and data regulation on research and innovation) lead for Slovenia, appointed by the Minister of Higher Education, Science and Innovation. Maja is an expert in the Data Governance Working Group of The Global Partnership on Artificial Intelligence (GPAI) that she previously cochaired from 2020 to 2023. Maja is a board member of Communia, and has been the legal lead of Creative
Commons Slovenia since 2004.

Maja graduated from the Faculty of Law in Ljubljana (1996) and obtained her LL.M. from the Faculty of Law in Ljubljana (1999, Economics), Harvard Law School (2000, Law) and Facoltà di Giurisprudenza di Torino (2005, Intellectual Property), and her Ph.D. from the Faculty of Law in Ljubljana (2006, Copyright).

Whose journal is it anyway? Workshop on journal ownership

Generative AI is transforming the way knowledge is created, accessed and disseminated while simultaneously challenging fundamental principles of copyright law. This workshop provides a structured overview of the legal issues surrounding generative AI, following the lifecycle of AI systems—from the use of protected works as training data to the legal implications of AI-generated outputs.

The first part focuses on AI inputs, examining the copyright framework governing the training of generative AI models. It presents a comparative legal analysis of the approaches adopted in the European Union and other leading jurisdictions, reviews the most significant court cases and ongoing litigation, and discusses the practical implications of the EU Text and Data Mining (TDM) exceptions, with particular emphasis on Articles 3 and 4 of the DSM Directive. A Slovenian case study illustrates how these legal issues are emerging in practice and what they mean for research organisations and libraries.

The second part addresses AI outputs, exploring questions of authorship, the copyright protection of AI-generated content, and the broader legal challenges arising from the use of generative AI.

The workshop concludes with an overview of the forthcoming European debate on copyright and generative AI. It examines why legislative reform is increasingly considered necessary, what evidence the European Commission is currently gathering, the expectations of different stakeholders, and the possible directions of future policy.

The final discussion highlights the strategic importance of developing sovereign European generative AI and the central role of the mandatory research Text and Data Mining exception under Article 3 of the DSM Directive in enabling innovation, supporting research infrastructures, and strengthening Europe’s digital and technological sovereignty.

Among the countries to be analyzed, Slovenia has already adopted some of the most advanced open science strategies in the EU, supported by legislative measures such as rights retention obligations and the secondary right to publication included in the Scientific Research and Innovation Act (ZZrID). These provisions strengthen the ability of researchers to retain key substantive copyrights in negotiations with publishers, allowing them to publish their research results in open access, thereby accelerating the practical implementation of open science principles. The Slovenian approach can serve as a valuable model for other countries in the region.

The project Mapping of Open Science is supported by the Knowledgerights 21 (KR21) and conducted by Open Data and Intellectual Property Institute with the cooperation of members of the KR21 Regional Alliance.

Johan Rooryck currently is a co-coordinator of the European Diamond Capacity Hub at OPERAS alongside Pierre Mounier, and a PI on the EU-funded ALMASI project that aims to build a non-profit, Diamond Open Access (OA) ecosystem across Europe, Africa and Latin America. He has been involved in various Open Access organisations and projects, from cOAlition S to the EU-funded DIAMAS, CRAFT-OA, and PALOMERA projects. He is co-editor-in-chief of the Diamond OA journal Glossa: a journal of general linguistics, a journal that transitioned to Diamond OA in 2016 when its Editorial Team and Board, as well as its reader and author community, decided to abandon the Elsevier-owned journal Lingua to found Diamond OA Glossa. He is a member of the Academia Europaea, a doctor honoris causa of UiT – The Arctic University of Norway, and a visiting professor at Leiden University, where he held the chair of French linguistics from 1993 to 2020.
